Landlord ConditionsThe Landlord's signature guarantees that they have read and verified all information regarding the property which is being let and that the rent amount is correct.In the event of the tenant failing to sign part of this agreement, cancelling or dishonouring their part of the agreement, Edinburgh Festival Rentals will not be held responsible. Edinburgh Festival Rentals will try to provide a new tenant for the property, but no guarantee is given. As noted in the rental agreement enclosed. Please see commission and fees at the end of the conditions Property Standard and ContentsIt is the responsibility of the Landlord to ensure that the property is ready to let and to inspect the property on the tenant's departure. All properties should be handed to tenants in a clean and tidy state, fully functional to accommodate the numbers as per the agreement. Cleaning should be of a professional standard and beds should be made up with good quality linen, freshly laundered and ironed. Adequate linen and towels must be provided for each tenant. Should the landlord fail to provide adequate quality and quantity of linen this will be provided by Edinburgh Festival Rentals and the cost of hire or purchase duly charged. Landlords should not expect linen to be laundered prior to tenant's departure. If there is more than one tenancy it is the landlord's responsibility to arrange laundry and cleaning of the property between lets. Should the tenants find the property dirty, untidy or otherwise dysfunctional they may be relocated and the let cancelled. Alternatively cleaning and other repairs will be carried out and duly charged. Should the property not meet the standards intimated by telephone, letter, photo or otherwise, Edinburgh Festival Rentals will not be held responsible for any loss of income. Landlords should leave clear, labelled instructions re appliances, immersion heater, central heating, boilers etc, and rubbish collection days, giving numbers of any appliance or service contract guarantees. Tenants are not expected to wait in attendance for service/repair engineers. Should emergency services have to be carried out Edinburgh Festival Rentals will make every effort to contact the landlord, otherwise work will be carried out at Edinburgh Festival Rentals' discretion and duly charged. KeysThe number of sets of keys, as indicated on the rental agreement, must reach Edinburgh Festival Rentalsat least 14 days prior to the start of the let. It is the landlord's responsibility to ensure that all sets of keys (particularly newly cut sets) are tested and the locks are in good working order. InsuranceLandlords should ensure that the property and its contents are covered by their insurance policy, including any extra insurance required to cover a let falling through or being cancelled. Tenants are advised to have their own belongings insured separately. Utility BillsCouncil tax, use of utilities and telephone rental charges are included, unless otherwise stated on the booking form. If requested, the Landlord should ensure that a working telephone is provided with incoming and outgoing service. An itemised and edited account of all calls +VAT must be submitted to Edinburgh Festival Rentals at the end of the let so the tenant's deposit return can be finalised. (BT provides a 'Call My Bill' service as well as full internet billing services at BT.com.) Due to the use of mobiles, most tenants will now accept a landline which only allows incoming calls (some often request this so they are not liable for bills). BT and other providers will happily set this up for you. If Wireless Internet Connection is advertised as a feature of the property, this must be provided. Failure to provide this feature if promised will result in the rental being cancelled or the Landlord paying the tenant £200.00 in compensation.Payment of RentThe rent and all deposit monies received will be held, in trust, by Edinburgh Festival Rentals in a 'Client Account' until the end of the lease and until any deductions for breakage, damage, phone usage, or any other financial claim have been agreed between landlord and tenant. Rent due will be paid, less commission, together with agreed deductions up to 4 weeks from the end of the lease except where any receipts for deductions have not been received and / or agreed with the Tenant. If the landlord fails to provide Edinburgh Festival Rentals with valid receipts or reasonable estimates for deductions within 3 weeks of the lease ending, deposits (or part thereof) may be returned to tenants without further recourse to the landlord. Payments will be procured from the tenants prior to arrival. If tenants fail to pay the rent in full, access will be denied to the property. In the event of tenants not honouring their payments or other obligations under the terms of their agreement, Edinburgh Festival Rentals will not be held liable. Any disputes between landlords and tenants over rent or deposit deductions can be dealt with by Edinburgh Festival Rentals if requested. An administrative charge of 15% will be levied on all associated bills plus any other costs i.e. viewing, telephone, fax, meetings, etc. If the landlord and tenant cannot agree on an amount in settlement in respect of any dispute over refund of deposit or any other financial claim and fail to agree upon a mutual arbiter within three months of the tenancy ending, Edinburgh Festival Rentals will apportion funds between landlord and tenant as they feel fit and neither the landlord nor the tenant will have any claim against Edinburgh Festival Rentals in respect of that apportionment. CurrencyFor lets that are paid in the currency of the US dollar, commission is deducted from the amount in dollars. The remainder will be exchanged into pound sterling before payment is made to the landlord. The rate of exchange used will be determined at the date on which the tenancy agreement is signed by the landlord.
